Every year, more and more laws are passed that affect employers and protect employees, creating an endless stream of requirements for employers, as well as employment-related claims and litigation. In addition to broad preventive employment services for our clients, we offer and conduct workplace audits to assist clients with identifying compliance vulnerabilities and developing strategies to address them.

AMERICAN WITH DISABILITIES (ADA) PUBLIC ACCESS CLAIMS AND COMPLIANCE

The Firm represents and advises a wide array of businesses in defending litigation and compliance under Title III of the Americans with Disabilities Act of 1990 (the “ADA”). Over the past 20+ years, there has been an explosion in the number of ADA Title III lawsuits being filed, particularly in Florida. Such ADA lawsuits often allege the existence of “physical barriers,” such as inaccessible restrooms or parking lots. Over the past few years the scope of ADA lawsuits has expanded to allegations that a business’ website is inaccessible to visually-impaired individuals or is otherwise non-compliant.

Our team has years of experience defending the South Florida business community from these claims in the courtroom and while working with a select group of experts, including architects and IT specialists, when making recommendations for necessary modifications to achieve ADA compliance.
